Man violates probation terms and is sent to jail

BEDFORD – Lawrence County Superior Court I Judge John M. Plummer III sentenced a Mitchell man to 1,602 days in the Indiana Department of Corrections.

Josiah Asbery, 26, of Orleans, pled guilty in a negotiated plea deal to domestic battery and domestic battery on a person less than 14 years old. Both charges were Level 6 felonies.

The plea agreement, negotiated by Deputy Prosecutor Sarah Cummings, called for Asbery to serve 910 days in the Indiana Department of Corrections with 545 days suspended to supervised probation. Asbery violated his probation, and a new criminal charge was filed, which violated the terms of his probation.

“Every day, people choose how they want to live,” said Deputy Prosecutor Sarah Cummings. “Some people make good choices while others continue on the path that got them into their current situation. The Defendant continued doing what landed him in this situation, and refusing to do what he said he would do when he entered the plea agreement resulted in him serving the rest of his time in prison.”
