Mitchell man arrested on alcohol and related charges

HENRYVILLE – Mitchell man arrested on operating a vehicle while intoxicated charge and other felonies.

On Friday around 2 p.m., Trooper Justin Mears observed a black Chevrolet SUV traveling north on US 31 from Henryville. The driver was drifting and weaving all over the roadway. He followed the SUV, which crossed the left of the center line and nearly struck a southbound SUV head-on. The driver also drifted off the highway and almost into the grass.

The driver was stopped, and Mears observed numerous indicators of impairment along with two juvenile passengers in the car (one was his daughter and the other the daughter’s friend). Mears also learned the driver had an arrest warrant out of Lawrence County for OWI.

The press release did not provide the name of the person arrested. The WBIW News Department has contacted ISP and has yet to receive further information.

The driver failed field sobriety tests and was then offered a Drug Recognition Evaluation, to which he agreed.

During the DRE evaluation, additional impairment indications were observed. He was offered a certified blood test, but he refused.

His charges are as follows:

  • OWI- Prior conviction (Felony 6)
  • OWI- Minor present x2 (Felony 6)
  • Neglect of a dependant (Felony 6) OWI (A Misdemeanor)
  • Warrant for OWI from Lawrence Co.
