Spencer man sentenced to prison after failing to comply with probation terms

BEDFORD — Lawrence Superior Court II Judge Robert Cline sentenced a Spencer man to the Indiana Department of Correction after failing to comply with his probation terms.

On October 7, 2021, Brandon R. Smith, 30, Spencer, pleaded guilty to possession of methamphetamine,
a Level 6 felony. He was sentenced to six years in the Indiana Department of Correction, with four
years suspended. He was placed on probation for 730 days.

However, while on probation, Smith was charged with new criminal offenses. He pleaded guilty to
possession of methamphetamine, a Level 3 Felony, on March 26, 2024, in a negotiated plea agreement
with the State of Indiana.

He was sentenced to nine years in prison with six years executed and remaining suspended, which violated the terms and conditions of his probation.

As a result of his guilty plea, Judge Cline revoked Smith’s suspended sentence, sentenced him to four years in prison, and Smith’s probation was terminated unsuccessfully.

The two sentences are to run consecutively.
