Mitchell man faces several charges after resisting police

MITCHELL – A Mitchell man was arrested Friday night on several charges after Mitchell Police officers went to serve an arrest warrant on 50-year-old James Kirk at a home in the 220 block of East Grissom Street.

Kirk was arrested on charges of resisting arrest, possession of meth, possession of marijuana, possession of drug paraphernalia, burglary, residential entry, invasion of privacy, and criminal mischief.

Officers found Kirk sitting on the couch and they told him that they had a warrant for his arrest.

Kirk became argumentative, stated that he wanted to make a call and that he was not going to jail. 

Kirk refused to stand up to allow officers to place him in handcuffs but finally stood with a stagger. Kirk threw a cylinder container with a blue substance in it against the wall. Officers later found this container to also house a glass smoking pipe, a cut straw, and a plastic baggie containing meth.

Kirk continued to resist and struggle with the officers. During the struggle officers had to deploy a TASER weapon twice before they could restrain Kirk.

IU Health EMS arrived on the scene. Kirk refused to be transported to the hospital where he was medically cleared and transported to jail.

Kirk was also wanted on a warrant for invasion of privacy, burglary, theft, and criminal mischief after an incident on July 20th. 

On that day Mitchell Police were alerted Kirk had violated a no-contact violation.

 The woman called 911 after she witnessed Kirk at her home. The no-contact order was filed in January after Kirk was arrested for domestic battery.

The woman told police that Kirk had been coming to the home and vandalizing the property after kicking in the front door of the home and breaking into a shed. Several items were missing from both the home and shed. Kirk is also accused of breaking two televisions and picture frames. He also spray painted random items in the home black. The washer and dryer were missing and he had left the water to the washing machine running, flooding the living room.

Neighbors told police they had seen Kirk going in and out of the residence, removing items from the property.

The officers went inside the home and found Kirk and removed him from the property. Kirk told officers he had every right to be there and “this is why this crazy b**** gets her head thumped all the time because of her mouth”. 

Police say the house “was a complete mess”.

The information was forwarded to the Lawrence County Sheriff’s Department and a warrant was issued for his arrest.
