SPRINGVILLE — A Springville man was arrested Saturday morning after allegedly spitting on his wife and pushing a relative during a domestic dispute in front of two young children.
Kyle M. Pemberton, 35, was taken into custody on Dec. 20 and faces charges of domestic battery in the presence of a child under 16 and battery involving bodily waste.
According to a probable cause affidavit, Captain Harrison Fleetwood and Officer Kyle Long of the Lawrence County Sheriff’s Department responded to a home in the 2700 block of Harrodsburg Road at approximately 12:34 a.m. following an emergency call regarding a physical altercation. Officers from the Indiana State Police also assisted at the scene.
Upon arrival, deputies spoke with Pemberton, who stated he and his wife had been in a verbal argument and denied that any physical contact occurred.
However, statements provided to officers indicated that an argument over Pemberton’s alleged intoxication escalated after the couple arrived home. A witness reported seeing Pemberton spit in his wife’s face during the incident.
A female relative reported that when she attempted to step between the couple in the kitchen, Pemberton pushed her back multiple times. The incident occurred while two young children—a 2-year-old and an infant—were present inside the residence.
The Department of Child Services was notified, and a report was filed. Pemberton was subsequently arrested and transported to the Lawrence County Jail.
Those arrested are presumed innocent until proven guilty in a court of law.
