Bloomington man sentenced to prison for violating probation terms

BEDFORD – A Bloomington man will serve time in the Indiana Department of Correction after failing to adhere to the terms of his probation, Lawrence Superior Court I Judge John M. Plummer III ruled on Wednesday, April 9.

Robert Destefano, 58, had previously pleaded guilty to a charge of possession of methamphetamine, a Level 6 felony, as part of a negotiated plea agreement. As a result of this plea, Destefano was initially sentenced to three years in the Indiana Department of Correction, with the entirety of the sentence suspended. He was then placed on supervised probation for two years.

However, Destefano repeatedly violated the conditions of his probation, leading to the revocation of his suspended sentence. Judge Plummer subsequently ordered the original sentence to be executed. Destefano was sentenced to one year and 278 days in the Indiana Department of Correction, with credit for the 38 days he had already served in jail.

Senior Deputy Prosecutor Sarah Cummings commented on the sentencing: “This Defendant was given the opportunity to stay in the community and work with probation to rehabilitate his life. However, the defendant ignored the terms and conditions in which he agreed to participate. You do not get to pick and choose what you want to do while on probation, and the prison was the appropriate result.”
