Mother and son duke it out, both arrested

MITCHELL – Mitchell Police officers responded to a report of a domestic fight on Monday, October 2 that landed two people behind bars.

Officers were requested to 1216 Elm Park Drive at 4:25 p.m. after a report of a physical domestic fight.

Prior to police arriving the caller reported 23-year-old Cody Middleton had attacked his mother and her husband.

When officers arrived and approached the apartment they could hear yelling from within. An officer opened the front door and found the female caller leaning against the wall and 48-year-old Cheryl Middleton sitting on the floor in front of a chair that had been knocked over. She was holding the left side of her face. She had suffered a contusion about the size of a golf ball above her left eye.

Police found items scattered throughout the floor and everyone inside the apartment was upset.

Cody was found sitting on the couch with blood on his face.

Cheryl’s husband had a small cut on his hand. The husband told police that Cody had attacked Cheryl and kicked her in the head multiple times and attacked him.

Cody told police he and his mother were inside on the couch drinking and that is when her husband got between them and Cody hit Cheryl’s husband. Cheryl attempted to stop the attack and got between the two men.

Cody said Cheryl’s husband punched him in the eye but he did not want to file charges. He then admitted to slapping his mother across the face but didn’t remember anything else because he blacked out.

Cheryl’s husband told police Cody was calling his mother explicit names and shoved her. He told Cody to stop but he continued and shoved Cheryl to the floor and began kicking her. He confronted Cody and that is when Cody attacked him and he fell over a table and onto the floor. The husband admitted he had hit Cody in the face in self-defense.

The female caller told police the same story as Cheryl’s husband. She told police she had to pull Cody off Cheryl’s husband. She told police Cody had kicked Cheryl multiple times and even put his foot on her head. This is when she called 911.

Mitchell Volunteer Fire Department treated Cheryl’s injuries. She continued to be abusive with firefighters and officers at the scene. First responders stopped treating Cheryl because of her belligerent conduct.

Officers warned Cheryl about her conduct to no avail.

Police arrested Cody on two counts of domestic battery causing bodily injury.

Cheryl continued to be belligerent. She proceeded into the kitchen and grabbed an open bottle of Vodka and began to take the cap off. She was told to put the bottle down and she refused. An officer escorted Cherly to a chair and she forcibly pulled away from the officer screaming “Take me to jail”. The officer had to forcibly place Cheryl on the floor and place her in handcuffs as she continued to act out.

Police arrested Cheryl on charges of disorderly conduct, and resisting arrest.

In transit to the jail, Cody admitted and apologized for his action to the officers stating, “I shouldn’t have hurt my mom and (her husband) he didn’t attack me”.
