Intoxicated woman charged with battery of her children

MITCHELL – A woman was arrested on Tuesday after a 16-year-old male went to the Mitchell Police Department and reported his friend’s mother was intoxicated and pushed him, her son, and her daughter at a home in the 700 block of South 6th Street.

The woman’s daughter reported she was in her room with her 16-year-old male friend when her mother 43-year-old Penny Duncan began to yell and swear. The male was able to video the encounter. During the verbal attack, the female’s brother entered the room and Duncan verbally attacked him. At one point in the video, Duncan forcefully pushes her son causing him to lose his balance and step back. Her daughter then intervenes and attempts to keep Duncan from attacking her brother by grabbing her arm. Duncan then pushes her daughter. The 16-year-old male attempted to leave the home and Duncan screamed at him and forcefully pushed him.

Officers responded to the home to speak to Duncan. Officers found her sitting on a couch in the living room with a vodka bottle beside her. Duncan was intoxicated and denied there was an altercation. Police attempted to show Duncan the video of the altercation but she refused to look at it and continued to swear at the children. Duncan was warned about her behavior and was told to stop.

Duncan was then detained. While escorting Duncan from the home she continued her belligerent behavior.

The children told police they did not feel safe in their home. This is not the first time police have responded to the home because of Ducan’s drinking and disorderly conduct.

Duncan is facing two counts of domestic battery, battery, and disorderly conduct.

The male teen was left in the care of his parents and Duncan’s children were left in the care of their father.
