Judge Richard W. Poynter granted the mistrial at the request of Green’s attorney, Mark Dove. Green was also on trial for four counts of sexual misconduct with a minor, felony counts of vicarious sexual gratification and conduct, and one felony count of incest.

Green’s arrest in October 2023 followed a Seymour Police Department investigation that began in September 2023 into allegations of inappropriate sexual contact with an underage victim that reportedly began 22 years prior and lasted for approximately 11 years. Following the initial investigation, Green, then 57, was arrested on charges of child molesting, a Level A felony, incest, a Level B felony, and vicarious sexual gratification, a Level B felony. A search warrant executed at Green’s residence reportedly yielded evidence against Green.

Green’s bond was set at $100,000, and Judge Poynter issued a no-contact order regarding the alleged victim and a second individual who came forward. Green later posted bond and was released.

Jury selection began on Monday, April 28, 2025, in Jackson Circuit Court in Brownstown, with testimony commencing the following day.

However, on the morning of Wednesday, April 30, before the trial’s scheduled resumption at 1 p.m., Green was involved in an incident on County Road 400 West south of U.S. 50. Sheriff’s deputies responded to a report of a male, later identified as Green, sitting in his vehicle in the middle of the road and threatening suicide.

After speaking with dispatchers and his attorney, Green reportedly agreed to put down the gun and walk toward the deputies. Green was arrested, and police confiscated a revolver containing six .357-mm cartridges.

Jackson County Emergency Medical Services transported Green to Schneck Medical Center in Seymour for a medical evaluation. Once cleared, Green was arrested on a new charge of unlawful carrying of a handgun, a Class A misdemeanor. On May 1, Judge Poynter reinstated Green’s bond and ordered that Green was not to possess any firearms.

As a result of this incident, a mistrial was declared in the ongoing child molesting case. A new trial has been scheduled for 8:30 a.m. on November 10th in Jackson Circuit Court.
