According to Officer Cody Grogan’s affidavit, the incident began when officers responded to a report of a domestic altercation in the 100 block of East Deckard Drive. Upon arrival, officers spoke with a male who claimed that Setlak had attacked him after he attempted to take a small green tube from her, which he believed contained drugs. He stated that he had been trying to help Setlak by taking the tube away from her. He handed the officer the small green tube, which contained white oblong pills and a small baggie.

The male suffered scratch marks on his arm and behind his ear.

He reported that Setlak fled the scene and went to her father’s nearby residence. Setlak and her father later returned to 124 East Deckard Drive, where Officer Grogan questioned her about the contents of the green tube. Setlak admitted that the tube belonged to her and confirmed that it contained methamphetamine and her prescribed medication, Gabapentin. She also acknowledged attacking the male when he attempted to put his arms around her.

The male declined to provide a voluntary statement or sign a domestic battery probable cause affidavit.

After gathering evidence and documenting the scene, Officer Grogan placed Setlak under arrest and transported her to the Lawrence County Jail. Upon inventorying the contents of the green tube back at the Mitchell Police Department, the officer found two white oblong pills, which were identified as Gabapentin, matching Setlak’s statement. A small clear baggie containing a small amount of a white crystalline substance was also discovered. The substance tested positive for methamphetamine.

Setlak was charged with possession of meth and domestic battery and was remanded to the Lawrence County Jail.

Those facing criminal charges are considered innocent unless convicted through due legal proceedings. Accusations alone do not imply guilt; the judicial system will evaluate the presented evidence to reach a verdict.
