Mitchell man arrested after welfare check leads to protective order violation

MITCHELL — A Mitchell man was arrested following an investigation into a reported disturbance and an alleged violation of a protective order at a local veterans organization late last year, police said.

Tate A. Stewart, 29, was arrested in connection with an incident reported around 10:30 p.m. Dec. 31 at the American Legion Post 250 in Mitchell, where officers were dispatched for a welfare check, according to a probable cause affidavit.

Major Jacob Kuhlman and Officer McMillen of the Mitchell Police Department responded to the call, which had been placed by Stewart. He reported concerns about a woman at the location and requested officers check on her well-being.

When officers arrived, they made contact with the woman, who police said showed no signs of impairment. She told officers that Stewart had arrived earlier in the evening, caused a disturbance, and made threats before leaving the area. Her account was corroborated by a staff member at the establishment, police said.

During the investigation, officers confirmed there was an active protective order involving Stewart. While officers were still on scene, Stewart reportedly contacted the woman multiple times by phone, which police said violated the order.

Based on the investigation, police said they had probable cause to seek a warrant for Stewart’s arrest on a charge of invasion of privacy, a Class A misdemeanor.

Those arrested are presumed innocent until proven guilty in a court of law.
