Mitchell man charged with operating vehicle while intoxicated following motorcycle crash

MITCHELL— A Mitchell man is facing charges of operating a vehicle while intoxicated (OWI) following a single-vehicle accident that damaged a residential property in September.

According to a probable cause affidavit filed by the Mitchell Police Department officers were dispatched to an accident with possible injuries at approximately 7:39 p.m.on Saturday, September 27, 2025, at 1130 West Brook Street.

MPD Officers Cody Grogan, Garrett Jacobs, and Cody Blackwell responded to the scene. The affidavit identifies the driver as Peyton S. Moore, 25, of Mitchell.

Upon arrival, Officer Grogan assisted in evaluating Moore, who stated he had consumed “a little alcohol earlier in the day.” Moore admitted to driving the motorcycle, a red Honda XR650L belonging to a friend’s father. He claimed that he lost control and jumped off the bike just before it struck the front porch and the railing of a residence in the 1000 block of Brook Street. Moore allegedly attributed the wreck to an animal running out in front of him.

Officer Grogan administered a preliminary breathalyzer test, which registered a blood alcohol concentration of 0.114.

Due to the nature of the crash, Emergency Medical Services (EMS) evaluated Moore. Though he refused immediate treatment at the scene, Officer Grogan noted that standard field sobriety tests had to be discontinued because Moore complained of increasing pain and balance issues, suggesting a possible head injury.

Moore was then read his Implied Consent and Miranda Rights, and consented to a blood draw chemical test. Officer Grogan transported him to IU Health Bedford for both the blood draw and medical clearance. After the blood draw was completed by hospital staff. Moore was transferred to the hospital’s care due to the severity of his injuries.

The subsequent toxicology report from the Indiana State Department of Toxicology confirmed the presence of alcohol. The results stated that the level of Ethanol in Moore’s blood was 0.095. This value is above Indiana’s legal limit for intoxication, which is 0.08.

Based on the evidence gathered, including Moore’s statements, the initial result, and the confirmed blood test result, Officer Grogan established probable cause to believe Moore committed the offense of operating a vehicle while intoxicated. He requested a warrant be issued for Moore’s arrest. Moore was detained on December 11.

The police report noted that the motorcycle owners agreed to pick up the damaged vehicle to avoid towing.
