BEDFORD — A Bedford man was arrested Monday morning after he allegedly returned to an apartment from which he had been recently evicted and formally trespassed.
Johnny J. Kimmel, 46, of Bedford, was taken into custody on Monday, October 20, and faces a preliminary charge of criminal trespass.

According to a probable cause affidavit filed by Bedford Police Department Officer Derek Blackwell, police were dispatched to the 3011 Ted Jones Drive address at 10:19 a.m. after receiving a report of a male, identified as Kimmel, trespassing.
BPD dispatchers confirmed that Kimmel had been issued an official trespass notification for apartment D just four days earlier, on October 16, by Sergeant Toby Gerkin.
Upon arrival, Officer Blackwell spoke with the property manager, who confirmed that Kimmel had been evicted and trespassed from the property and was currently inside Apartment D.
Officer Blackwell made contact with Kimmel when he opened the door. The affidavit states that Kimmel admitted speaking with an officer recently about being trespassed, but claimed his attorney had advised him that he was allowed to be on the property.
Kimmel was subsequently placed under arrest, processed at the Bedford Police Department, and then transported and lodged at the Lawrence County Jail.
