Traffic stop leads to OWI arrest after failed field sobriety tests

BEDFORD — A Bedford man was arrested early Saturday morning, September 27, on charges of operating a vehicle while intoxicated and OWI endangerment after a traffic stop near State Road 37 and Brock Lane.

Bedford Police Department Officer Taylor Daugherty initiated the stop after clocking a white 2019 Chevrolet Malibu traveling north on State Road 37 at 66 miles per hour in a 55 mph zone around 1:24 a.m.

The driver was identified as Cooper Mack, 21, of Bedford.

Upon making contact with Mack, Officer Daugherty immediately noticed signs of impairment. According to the probable cause affidavit, Mack’s speech was slurred, and his eyes appeared bloodshot and glossy. When asked if he had been drinking, Mack denied it, stating he was coming from a friend’s birthday party.

Mack agreed to perform standardized field sobriety tests, which he failed. He subsequently agreed to a Preliminary Breath Test (PBT), which registered a blood alcohol content of 0.111.

Following the PBT, Mack was read the Miranda Warning and the Indiana Implied Consent, both of which he stated he understood. He then submitted to a certified chemical test and was placed in handcuffs.

At the Bedford Police Department station, Mack was given a chemical breath test; the certified result registered a 0.126 breath alcohol content at 2:06 a.m.—significantly above Indiana’s legal limit of 0.08.

During questioning at the station, Mack admitted to purchasing a 12-pack of Busch Light bottles but stated he was unsure how many he had consumed that night.

Mack was subsequently transported to the Lawrence County Jail for housing on the two criminal offenses.

The vehicle was released to a family member called by the passenger, with Mack’s consent.
