According to a probable cause affidavit filed by Bedford Police Officer Bailey Duprey, police dispatch received a call reporting threats at Surber’s address at approximately 2621 Industrial Park Drive.

Upon arrival, Officer Duprey spoke with Surber, who stated he was “just mad”. Surber admitted he had been arguing with another male who owed him $5.00.

Officer Duprey then spoke with the victim, who said that when he pulled into the parking lot, Surber became aggressive. He told the officer that the argument was over an unpaid gas station soda, despite an earlier agreement between the two. The victim also stated that Surber had been harassing him for over a week, at one point almost breaking into his apartment. During the argument on Wednesday, the male claimed Surber told him he would “slit his throat”.

When Officer Duprey confronted Surber a second time, Surber again said he was “just mad” and that “it was nothing”. When asked if he had a weapon, Surber replied that he “always has a knife on him”. Officer Duprey patted him down and found a large knife in his waistband, after which Surber was placed in hand restraints and taken into custody.
