Teens cited in $800 Walmart theft case involving concealed merchandise and trespass orders

BEDFORD—Two 18-year-olds, Aubrey Nicole Fox of Bedford and Emmalie E. Miller of Springville, were cited in Lawrence County Superior Court I following an alleged theft incident at Walmart on Sunday, May 18.

According to an affidavit for probable cause filed by Officer Michael Bell of the Bedford Police Department, authorities responded to a call regarding a theft at the Walmart located at 3200 John Williams Boulevard at approximately 3:01 p.m. on May 18.

Upon arrival, Officer Bell made contact with asset protection personnel and three individuals identified as Emmalie Miller, Aubrey Fox, and another juvenile. Walmart asset protection personnel advised that the three females had been caught committing theft and that they wished to pursue charges.

A Walmart Asset Protection Associate provided a written statement detailing the incident. The associate observed the three individuals selecting items in the apparel section, moving quickly through the store, and periodically meeting with Miller’s mother. The individuals were later seen concealing items in bags and then continuing to select and bag items from other sections of the store.

The group then met with Emmalie Miller’s mother and waited for her to check out. As they waited, a Self-Checkout (SCO) host attempted to check the girls’ receipts, to which they all replied they did not have one and couldn’t remember which register they used. Despite an offer for assistance, Aubrey Fox allegedly pushed a cart with merchandise past the last point of sale. At that point, two Walmart asset protection associates stopped them in the General Merchandise vestibule.

Officer Bell separated Aubrey Fox and Emmalie Miller and advised them of their Miranda Warnings. Emmalie Miller declined to speak, but Aubrey Fox stated that she understood and was willing to discuss the incident. Fox suggested that Emmalie Miller pressured her into stealing items and even brought the bags used in the theft. Fox also stated that Miller had been stealing from Walmart for some time.

Following interviews, both Aubrey Fox and Emmalie Miller were served with trespass notifications. Aubrey Fox’s father arrived on the scene and also received a copy of the trespass notification. All acknowledged and signed the forms.

Due to the concealment of items, a probable cause search of Emmalie and Aubrey’s bags was conducted. More stolen merchandise was found in Emmalie’s bag, but nothing of evidentiary value was found in Aubrey’s. Both were explained their summons and released from the scene. The third juvenile involved was advised of a promise to appear for Lawrence County Juvenile Probation on May 21, 2025, at 9:00 a.m.

The total value of the theft, excluding items in Emmalie’s bag, was $726.24 pre-tax. An additional $75.93 pre-tax in stolen items was found in Emmalie’s bag.
