Bedford man arrested for public intoxication after incident at courthouse

BEDFORD – A Bedford man was arrested on charges of public intoxication and violating the conditions of his operator’s license after causing issues at the Lawrence County Courthouse.

While collecting information, Major Swanson noted that Borden appeared upset and was searching his vehicle for paperwork. A check of Borden’s driving record revealed he was operating on a conditional license, but could not locate the necessary documentation or vehicle insurance. Major Swanson instructed Borden to retrieve a copy of his conditional operator paperwork from the courthouse plaza and bring it to him, stating that if he returned with the correct documents, he would not be charged with a license violation.

However, at approximately 1:40 p.m., officers were dispatched to the Lawrence County Courthouse after a report of an intoxicated male causing issues. Courthouse security identified the male as Brian D. Borden, who had been involved in the earlier minor crash.

Responding officers made contact with Borden, who appeared disheveled, displayed erratic movements, had pinpoint pupils, and bloodshot, glassy eyes. Officers attempted to conduct standardized field sobriety tests, but Borden could not complete the tests. He refused a preliminary breath test and a SoToxa test.

Borden was taken into custody and placed in a patrol vehicle. The transporting officer noted a distinct odor of an alcoholic beverage emanating from Borden’s breath and person.

At the Lawrence County Jail, Borden was administered a preliminary breath test, which yielded a positive result of .166. He was subsequently booked into jail on a charge of public intoxication and operating a vehicle on a conditional driver’s license.

An affidavit of probable cause outlines the investigating officer’s belief that a crime has been committed. Criminal charges are accusations, and the defendant is presumed innocent until proven guilty in a court of law.
