Bedford man pleads guilty to domestic battery

BEDFORD – A Bedford man pleaded guilty to a charge of domestic battery in a negotiated plea deal in Lawrence County Superior Court II.

According to court records, Judge John Plummer III sentenced 43-year-old Brain Waggoner to 365 days in jail. Waggoner was given credit for two days served. Judge Plummer suspended 361 days of the sentence. Waggoner will serve 189 on unsupervised probation.

Waggoner will appear in court for a review hearing on January 9, 2023, at 8:30 a.m.

Waggoner was arrested in July 2022 after officers were called to the Circle K Gas Station located at 729 16th Street in reference to a domestic dispute.

Officers arrived and found Waggoner, outside of the station, while his wife was inside the convenience store.

The woman claimed Waggoner she and her husband were taking steps to get back together when she learned that he was homeless. She called a friend to come to pick her up, causing Waggoner to get upset.

He grabbed and squeezed her arms, leaving bruises. She also claimed that he allegedly threw his polar pop drink at her. The woman claimed she is diabetic and bruises easily. She claimed this was an ongoing issue with Waggoner as he had placed his hands on her before. Waggoner claimed he did not hit her with his drink, and he was hanging around to have a word with the man picking up his wife.

Waggoner was then arrested and placed in the patrol vehicle on a charge of domestic battery.
