Mitchell Police make arrest after open fist, face punch was made

MITCHELL – A Mitchell man was arrested Wednesday after Mitchell Police officers were called to a home in the 400 block of West Warren Street after a report of an intoxicated male breaking items in the home.

Officers arrested 36-year-old Joseph Agan on a charge of battery resulting in bodily injury and domestic battery.

When police arrived they found Agan laying in the yard near the sidewalk. 

Agan responded to police with “I want to file charges too” when they questioned him.

Police found an injured male in the home. He had a red abrasion on the left side of his face along with open wounds on his arms and red marks on his neck.

The male told police he and his son arrived at the home to show a female pictures of a turtle they had caught at a nearby creek. 

Agan entered the residence to locate “his bottle” and when he couldn’t locate it “it was on”. 

That is when Agan struck the male with a closed fist in the face and continued to swing at him. The man attempted to ward Agan off of him but was injured during the incident. Several items in the home were broken by Agan during the struggle. The female inside the home called 911.

Agan told officers he had drunk more than a pint of Vodka, but the other male started the fight.

An ambulance crew responded to the scene and treated the injured male who refused to be transported to a local hospital.

Agan was arrested. Police say Agan had a blood-alcohol content of 0.158 percent.
