Man Accused In Shooting To Attend Trial Today
(VALPARAISO, IN) - The man accused of shooting Indianapolis police officer Jason Fishburn goes on trial today in Valparaiso.
The trial was moved to Porter County because of pretrial publicity. Public Defender David Shircliff, defending Brian Reese, agrees with Marion County Prosecutor Carl Brizzi on this much, the issue is not merely whether it was Reese who pulled the trigger.
To prove the charge of attempted murder, the state must prove the shooter's intent.
Jason Fishburn and his wife, Tonya, are expected to be among the witnesses for the prosecution.
Shircliff says Reese may also testify in his own defense, but he says, "whether or not my client takes the stand is his decision and he can make that at any time during the trial."
The trial is expected to take about a week.
A full day could be added if judge Lisa Borges grants Shircliff's motion for a jury view of the crime scene back in Indianapolis.
The trial is being held in Porter County because of pretrial publicity.
