Death Penalty Upheld In 2001 Spencer County Rape, Murder
(STATEHOUSE) - A death sentence has been upheld for a convicted rapist and murderer.
The Indiana Supreme Court's decision to uphold the death sentence of 36-year-old Roy Lee Ward was unanimous.
Ward had tried to convince the court prosecutors failed to prove his brutality in the stabbing death of Stacy Payne in her family's home in Dale, Indiana in 2001 constituting the death penalty. Ward also tried to argue the sentencing jury was improperly picked.
Ward's first conviction and sentence was overturned in pretrial publicity, but a second jury took less than 45 minutes to recommend the death penalty a second time.
