(INDIANAPOLIS) - Marion County prosecutors have changed their story on a former police officers’ role in a New Years Day shooting death.

Prosecutors had said they had video evidence of Shannon McComas giving the gun used to kill Ronny Croom Jr. to Sunungura Rusununguko, now they say it is not clear McComas had a gun.

They now contend Rusununguko brought the gun to Durty Nelly's and retrieved it from a kitchen area before shooting into a crowd of 20, killing Croom and injuring four others.

Rusununguko is charged with 6 felonies, including murder. McComas is charged only with assisting a criminal. He is being held on 30 thousand dollars bond.

Both men again appear in court on Monday.
