(MUNCIE) - Results from a toxicology test show that a Ball State University student was drinking but was not legally intoxicated when he crashed his car, killing his front seat passenger.

21-year-old Todd Lamkin told police he lost control of his car in January and collided with a SUV. The crash killed 19-year-old Travis Smith.

Lamkin might still face prosecution for reckless homicide or involuntary manslaughter.
