Attorney General Opposes Reversal On A Mother's Death Charge
(STATEHOUSE) - Attorney General Steve Carter has filed an appeal to a decision of the Indiana Court of Appeals.
Carter says he opposes the Appellate Court's reversal of the conviction of a mother who gave her son an overdose of cold medicine. Misty Howell had been sentenced to eight years behind bars, but the court says the maximum sentence can only be handed down if there are aggravating factors in the case.
Carter has asked the State Supreme Court to re-instate the eight year term issued after the death of seven-week old Kyle Howell, who drank almost three times too much cough syrup.
