(MUNCIE) - A Muncie couple which won a $39-million lawsuit against Outback Steakhouse restaurants has had its verdict overturned.

The Indiana Supreme Court says lawyers for David and Lisa Markley did not warn outback's lawyers about a key witness who testified during the trial.

The case saw that witness testify William Whitaker was visibly drunk when his car struck the Markleys on their motorcycle after Whitaker left a Muncie branch of the steakhouse.

Outback had reportedly been selling alcoholic drinks for as little as a dime the night the accident happened.
