Boney's Attorney's Asking For A Mistrial

(NEW ALBANY) - Attorneys for a man convicted of killing a former State Trooper’s wife and two children are now asking for a mistrial over an alleged racist remark made by a juror.

Charles Boney's lawyers say a juror said he would make sure Boney "hangs from the highest tree." The person who heard the alleged remark reported it to Boney's lawyer after the trial.

Boney's attorney says that because the juror didn't indicate racial bias in a juror selection questionaire, Boney was denied the right to a fair trial. No hearing on the motion has been scheduled.
