(BOONVILLE) - The attorney for a man accused of fatally shooting a University of Southern Indiana student says his client wasn’t fully advised of his rights before police spoke to him.
Attorney Mark Phillips said during a Tuesday hearing in Warrick County that police gave 22-year-old Isaiah Hagan an "incomplete" Miranda rights warning and argued that his police statements should be suppressed.
Phillips says the investigation's lead officer paraphrased Hagan's Miranda warning advisement, and that paraphrasing "is unacceptable."
The Evansville Courier & Press reports prosecutors contend the Miranda warning and what it conveyed was given. A police detective says Hagan's body language and occasional nods showed he understood his rights.
Hagan is charged with murder in the slaying of 20-year-old Halee Rathgeber. Her body was found April 24 at a soccer complex.
