(INDIANAPOLIS) - Attorneys for the Indiana Bureau of Motor Vehicles and for plaintiffs in a class-action lawsuit against the agency differ by more than $100 million in how much it should repay motorists for overcharged license and title fees.
Attorney Irwin Levin argued during a one-day bench trial Wednesday the BMV should refund a total of $144 million in overcharges going back 10 years, plus interest.
However, BMV attorney Carl Hayes said the agency has calculated only $32 million in over charges. He also asked the judge to dismiss the lawsuit because the agency already is in the process of refunding the $32 million.
The Indianapolis Star reports Marion Superior Court Judge John Hanley did not immediately rule.
The BMV in 2013 settled a similar lawsuit for $30 million.
