(EVANSVILLE) - A mistrial has been declared in the case of an Evansville man accused of setting a fire at his apartment and leaving a bomb near a restaurant last year.
The mistrial in 26-year-old Caleb Loving's case was declared Wednesday morning. The Evansville Courier and Press reports (http://bit.ly/2auF51s ) questions arose about the accuracy of a court-appointed psychologist's evaluation that was one of two used to determine Loving was competent to stand trial.
Loving's defense has centered on arguments he should be found not guilty by reason of mental disease.
Vanderburgh Circuit Court Magistrate Kelli Fink declared the mistrial after Indiana State Police said the psychologist was unavailable to testify because he intentionally drove his car into a tree early Tuesday. She also cited questions about "the accuracy of the report."
