Prosecutor Won't Pursue Case Against State Lawmaker

Last updated on Monday, January 25, 2016

(VALPARAISO) - A special prosecutor says he will not pursue a criminal case against state Rep. Michael Aylesworth over allegations that he was inside a polling station illegally during election day in November 2014.

The Hebron Republican was accused of using GOP-issued credentials to serve as a poll book holder within a precinct while he was also a candidate in the election.

But prosecutor David Thomas says that even if it's true candidates can't be inside polling areas with credentials "it is doubtful the alleged violation is 'reckless' as specifically required for the offense."

The Times of Munster reports that Aylesworth declined to comment on the decision.

The site where Aylesworth was working is also where he votes.

The prosecutor said there were no allegations that Aylesworth disrupted the election.
