Federal Court Upholds Indiana's Limits On Cold Beer Sales

(INDIANAPOLIS) - Cold beer won’t be for sale in Indiana’s grocery or convenience stores any time soon.

A federal appeals court has rejected a challenge to Indiana's law that limits the sale of cold beer to liquor stores.

The appeals court in Chicago ruled Monday that the Indiana convenience stores association didn't prove that the state law was unconstitutional by treating grocery and convenience stores differently than liquor stores. The court said those are policy questions for the state Legislature to decide.

Indiana Petroleum Marketers and Convenience Store Association director Scott Imus says the group knew it faced a high hurdle to succeed in court and will return its attention to the Legislature in an attempt to change the law.
