Federal Judge Rules In Favor Of "Ballot" Selfies At Indiana Polls

Last updated on Wednesday, October 21, 2015

(INDIANAPOLIS) - Ladies and gentlemen, feel free to take as many “ballot” selfies as you want at the polls.

A federal judged ruled Monday in favor of the American Civil Liberties Union of Indiana's challenge of an Indiana law that would have made it illegal for a voter to take a "ballot" selfie at the polls or share it on social media.

Judge Sarah Evans Barker said the law, which took effect July 1, violates voters' First Amendment rights.

Barker's decision impacts the Nov. 3 election.

The ACLU of Indiana is happy about the court's decision.

"Taking a picture of one's ballot and sharing it with family and friends is an expression of pride and enthusiasm about voting, and is a form of political speech that must be protected," said ACLU of Indiana legal director Ken Falk.
