Civil Suit Filed By Two I-69 Crash Victims

(PRINCETON) - A civil suit has been filed on behalf of two victims involved in a September 24 crash on I-69 that claimed the life of two others.

Richard Hawley of Robert John and Associates, an Evansville-based firm, filed the suit in Gibson County Superior Court on Thursday.

According to a release from the attorney's office, Charles Joseph and Abigail Cura were seriously injured in the crash saying tens of thousands of dollars in medical bills would cause a huge financial burden as well as burdens for the other 25 victims, including the infant born to Christela Georges, one of the two women killed in the crash.

Hawley says the accident was not the victim's faulty.

The suit, which Hawley said requests recovery of the damages suffered from the accident including compensation for permanent injuries as well as punitive damages, will likely take some time to work out. Named in the suit are James D. Allen, driver of the converted passenger van with wooden benches for seats and worn tires, and his father, Robert D. Allen, Sr., the owner of the vehicle.

The suit alleges that defendants were negligent due to unsafe speed, unsafe lane movement, overweight load, driving on defective tires, improper safety equipment, and improper maintenance of the van. It is also alleges that the owner negligently entrusted the van to the driver.

"We have to figure out who's responsible," he says, adding at this point, it is unclear if Ameriqual, where the 24 victims of the crash worked, or Service Xpress, the temp agency from which the victims were hired, had any to do with the transportation arrangements which cost each of the victims $35 per week.

While Hawley says it is uncertain if the vehicle was insured, most policies would not cover vehicles used to transport persons in the manner in which the van was used.
