Court Upholds $5M Cap State Fair Stage Collapse Case

(UNDATED) - Plaintiffs challenging the limit on Indiana’s liability in the State Fair stage collapse have suffered another defeat.

The Indiana Supreme Court has declined to hear the appeal of a lower court decision that the limits are constitutional.

All but one of the eligible State Fair victims accepted the State's offer, sharing five-million dollars provided by law and six-million additional dollars approved by the General Assembly.

Yet to be resolved is the effort of the stage-rigging company, Mid-America Sound, to shift its legal bills onto the state. That case is on appeal to the State Supreme Court but oral arguments have not yet been scheduled.
