(SOUTH BEND) - A northern Indiana judge heard arguments on whether arrest records for the police department at the University of Notre Dame are subject to Indiana’s public record laws.
Damon Leichty, an attorney representing Notre Dame, argued Wednesday that university police are acting under powers granted by trustees, not the state, so they aren't subject to public record laws.
James Dimos, an attorney representing ESPN, argued that a department with the power to arrest should be subject to public scrutiny.
ESPN filed a lawsuit in January alleging the university was withholding police incident reports about possible campus crimes involving certain student-athletes. The lawsuit doesn't specify the incidents or which athletes may have been involved.
St. Joseph Superior Court Judge Steven Hostetler says he hopes to rule by April 20.
