Additional Charges Possible For Noblesville Woman In Fatal Drunk Driving Crash

Last updated on Tuesday, August 12, 2014

(NOBLESVILLE) - A Noblesville woman is facing additional charges after her arrest for drunk driving in a deadly crash that killed two people Saturday night.

50-year-old David Foster of Indianapolis and 28-year-old Whitney Miller of Fortville died in the crash. 49-year-old Marsha Foster was taken to the hospital with critical injuries.

The crash happened around 10:25 p.m. on the city's northeast side on Fall Creek Road, just south of 96th Street. That's near the Geist Reservoir in Hamilton County.

The driver of the other car, 22-year-old Paige Byers, had minor injuries after her car burst into flames. Bystanders helped get her out of the car.

Byers faces preliminary several charges, including two charges of causing death when operating a vehicle while intoxicated, two additional charges of causing death while intoxicated with a blood alcohol content of over .08 and causing serious injury when operating a vehicle while intoxicated. All charges are felonies.

A friend says Whitney Foster leaves behind four young children, and should be remembered as a good mother.

"She loved her kids," said Valerie McDowell, "Just made sure they were always taken care of and they had what they needed. Anyone could say she was a good mom, 'cause she was. She was a really sweet girl."

Whitney was to start her new job Monday.

The Marion County prosecutor's office asked for a 72-hour continuance to review charges against Byers.
