Lafayette Man Files Lawsuit After Officer Pushes Him From Wheelchair

(LAFAYETTE) - A Lafayette man has filed suit after a police officer pushed him over in his wheelchair.

The police car camera video of the incident led to the officer's suspension and demotion this month.

The victim, Nicholas Kincaid, is alleging First and Fourth Amendment violations as well as violations of the Americans with Disabilities Act.

Police had stopped Kincaid last October after complaints he told school officials he had a gun in a backpack. He did not have a gun but did have a pocketknife. After police told him he could leave, the video shows Kincaid rolling over a police lieutenant's foot.

The video shows the lieutenant pushing the man over in his wheelchair. The officer said he was just defending himself.

His police chief and the mayor wanted him fired but a disciplinary board settled on the suspension and cut in pay.
