Evansville Church Loses Appeal To Display Crosses

(EVANSVILLE) - An Evansville church has lost its appeal of a ruling that prohibits the City of Evansville from displaying crosses on city property.

The Seventh Circuit Court of Appeals has dismissed West Side Christian Church's appeal of a federal court injunction.

The stay kept the City of Evansville from putting up 31, six-foot-tall, plastic crosses in the city's popular Riverfront area. The Court ruled that the display would violate the Establishment Clause of the First Amendment.

The case had been brought by the American Civil Liberties Union which argued that the Constitution strikes a delicate balance between freedom of religion and separation of church and state.

The appeals court found that because the City of Evansville itself didn't appeal, it couldn't rule in favor of West Side Christian Church.
