(UNDATED) - A day after winning a landmark court case overturning Indiana’s ban on gay marriage, the American Civil Liberties Union plans to make sure all 92 counties are heeding the ruling.
ACLU Indiana legal director Ken Falk says he's not aware of any counties defying the ruling, but several told same-sex couples they were waiting for legal guidance. Some got that guidance quickly and began issuing licenses later Wednesday -- Falk will be keeping an eye on the others on Thursday, now that the word is out.
Attorney General Greg Zoeller's office is asking an appeals court to stay the court order while considering the state's appeal, but a spokesman says his office will advise clerks on the proper procedures to follow in issuing licenses in the meantime.
Judge Richard L. Young's ruling notes an unprecedented unanimity among different federal courts reviewing the issue in the last six months.
Even though the Supreme Court declined to settle the marriage question directly last year, Falk says its ruling laid the legal groundwork to strike down marriage bans. And Falk says public opinion has shifted generationally -- he says younger people just don't see any difference.
