Off-Duty Officers Arrested For OWI Had Xanax, Hydrocodone In System

Last updated on Wednesday, April 30, 2014

(MADISON CO.) - Toxicology results have confirmed that an off-duty Edgewood Police officer was under the influence of an anti-anxiety drug and a pain killer at the time of a deadly crash.

Investigators tell us that James Foutch's blood tested positive for hydrocodone and Xanax.

Police say Foutch was speeding when he plowed into the back of a couple's car earlier this month. The wreck killed 23-year-old Jesse Sperry and injured his then-pregnant wife, Rebecca. She gave birth to their daughter later that day.

Foutch is now facing charges of Operating While Intoxicated causing death and has been placed on unpaid administrative leave. He's scheduled to appear in court for his initial hearing on May 19th.
