(INDIANAPOLIS) - The Indiana Petroleum Marketers and Convenience Store Association (IPCA), is getting its challenge to Indiana’s law governing the sale of cold beer underway.
Thursday kicks off a two-day trial in U.S. District Court. IPCA and its members' filed a federal complaint in May 2013. They claim that Indiana's alcohol law violates the equal protection clause of the U.S. Constitution by restricting convenience, grocery and pharmacy stores to selling beer only at room temperature.
The stores are only allowed to sell beer warm, while competitors in the carryout market are allowed to sell beer cold. IPCA says that's even though convenience stores have a better compliance record with Indiana's alcohol laws.
IPCA Executive Director Scot Imus says it's not the job of government to "pick winners and losers in the marketplace."
Following court arguments, Chief Judge Richard Young is expected to take the matter under advisement and rule at a later date.
