(INDIANAPOLIS) - The Indiana Court of Appeals says a fine imposed on a teenager convicted in a fatal boating accident on Lake Monroe was too high.
Winston Wood was found guilty on three counts of leaving the scene of an accident -- he's currently on house arrest after completing nine months in prison.
A 2-1 appeals court says since all three counts stem from the same crash, it was illegal to fine Wood a thousand dollars for each count. Judge James Kirsch says he would have thrown out the convictions entirely.
Wood was trying to get his own boat to safety as it took on water, and Kirsch says it's unconstitutional for the law not to allow that to be taken into account.
