Teen Seeking New Trial As Juvenile

(WARSAW) - An Indiana youth who was sentenced to 25 years in an adult prison wants to be retried as a juvenile.

The teen plead guilty at age 12 to helping kill a friend's stepfather.

The state appeals court last year threw out Paul Gingerich's plea and sentence and said a Kosciusko County judge rushed when he waived the case to adult court. A hearing on Gingerich's request seeking juvenile status is scheduled for Monday afternoon in Warsaw.

He is now 15.

Gingerich was charged with conspiracy to commit murder in the fatal shooting of 49-year-old Phillip Danner in April 2010 at his home near Lake Wawasee, about halfway between Fort Wayne and South Bend. Two other youths also were charged and convicted.
