(HANCOCK CO.) - The Hancock County prosecutor will not press charges against Elizabeth Roberts for shooting and killing her husband last Friday.
Michael Griffin, the county prosecutor, said Roberts met the "defense of others" provision of Indiana law, providing for use of deadly force to defend others from serious bodily injury or death.
According to court documents, Roberts had gone to police, telling them her husband, Gary Roberts, had become irrational and dangerous especially when drinking alcohol or taking prescription medications.
Roberts also told authorities her husband was having suicidal thoughts and had a large number of guns and explosives in their Greenfield home.
According to a probable cause affidavit, Mrs. Roberts said when she told her husband authorities were coming, her threatened that everyone was going to die.
Police say Elizabeth Roberts shot her husband before authorities arrived.
