Muncie Police Officer Shot Man Who Was Strangling Him

(MUNCIE) - Muncie Police say an officer shot a man because he was strangling him and had already beaten another officer.

Police say the 911 call came in at 1:55 a.m. Sunday.

Police Chief Steve Stewart said the incident started with a report of a fight at Kruzzers Night Club, 3421 S. Walnut Street, on the south side of Muncie.

As officers arrived at the scene, one person at the bar, Brain Modglin, fled in a vehicle. A Muncie officer initiated a traffic stop of the vehicle a short distance from the bar.

During the stop, Modglin physically attacked the officer - repeatedly striking him in the face and head.

When a second officer arrived on the scene, Modglin physically attacked that officer, striking him in the head and face. He then pinned the officer against a fence and began to strangle the officer.

At that point, the officer pulled his duty weapon and shot Modglin.

Modglin was transported to Ball Memorial Hospital, and is reported in stable condition.

Both officers were transported to the hospital and were treated and released for their injuries.

Stewart says Modglin will be charged for battering both officers and for strangling the second officer.

According to their Facebook page, Kruzzers Night Club was hosting a Ladies Night and Pajama Party on Saturday night.
