Family Dispute Continues Over Control Of Holiday World

(SANTA CLAUSE) - The family dispute over the control of Holiday World is now before the Indiana Court of Appeals.

The court will try to settle a battle over control of the popular theme park between the widow of park president Will Koch and his brother.

Will drowned in the swimming pool at his home in 2010.

In January, a lower court judge ruled that widow Lori Koch was the majority shareholder of the holding company that operates Holiday World in Santa Claus, Ind. but Dan Koch appealed, saying an agreement signed by his brother required Lori to sell her shares to him.

There's been an ongoing fight over the value of those shares. Lori Koch says Dan agreed to pay her $32 million for them. He's offering $26 million.

There's no word on when a ruling will be made.
