(INDIANAPOLIS) - A truck driver was taken to jail Monday night after Indiana State Police officials said he was driving under the influence of alcohol and synthetic marijuana known as spice.

An ISP trooper was on the shoulder in an unmarked pickup when the semi driving past swerved and nearly struck the trooper's vehicle, ISP officials said in a news release.

When the trooper tried pulling over the truck, it refused to stop, the trooper said. The trooper was able to stop the vehicle by using stop sticks that deflated the tires.

James Michael Foster, 52, was hauling cheese, which wasn't compromised. Foster, who's from Mebane, N.C., was arrested on preliminary charges of operating a motor vehicle while intoxicated and resisting law enforcement.

The incident happened in Marion County on Interstate 70.
