(INDIANAPOLIS) - A battle is underway in the Indiana Court of Appeals for control of southern Indiana's Holiday World & Splashin' Safari.
The Indianapolis Star reports the brother of former park President Will Koch, who died in 2010, has filed a 43-page brief alleging two errors in a Vanderburgh County judge's ruling that awarded control of the park to Koch's widow, Lori Koch.
The appeal by Dan Koch, who is a Florida lawyer, aims to overturn the December ruling and allow him to buy his late brother's majority ownership in the amusement park.
The Star reports the appeal will decide whether control of the park remains in the hands of Lori Koch and her three college-age children or shifts to her brother-in-law, whom she fired as president soon after the December ruling.
