Parents Plan To Sue Rushville School

(RUSHVILLE) - The parents of two Rush County Middle School students plan to sue the Rush County School district after they say their sons were bullied.

Daniel Miller, of WISHTV8 reports, one of the attacks was caught on the school's surveillance camera.

Austin McDaniel and Logan Thompson are 8th graders at Benjamin Rush Middle School.

Both said they were attacked on school grounds.

Their attorney said the unprovoked attacks go beyond bullying.

Attorney Ron Frazier, says there is a 30 second video of Austin McDaniel being attacked.

The boy and his family are suing Rush County Schools after they say the 13 year-old was put in extreme danger.

The attack happened at Benjamin Rush Middle School.

On Monday, September 17th, McDaniel said he was walking to his locker when another student came up from behind and attacked him. McDaniel says the attack was so violent that he can't remember it.

Nicole McDaniel said it was an hour before she was even notified about the attack.

Eleven days before McDaniel was attacked at the middle school, McDaniel's friend, Logan Thompson was attacked by friends of the boy that attacked McDaniel.

Thompson was hit so hard it knocked him off his feet and his head hit the floor.

Rush County Schools Superintendent Dr. John Williams says the attacks are an isolated situation and has been dealt with.

Frazier says the school district then has 90 days to respond to the complaint if not the families will file suit
