Man Bitten By Police Dog Allowed To File Lawsuit

(INDIANAPOLIS) - An Anderson man bitten by a police dog while getting arrested five years ago can proceed with his lawsuit.

The Indiana Court of Appeals ruled Monday that Marquis Brooks can sue the Anderson Police Department.

Back in December 2006, after drinking and using marijuana, Brooks was running from police and hid in a shed.

The K-9 officer was able to track him down. Brooks said after he surrendered, the police dog bit him twice.

The appeals court ruled a jury should hear the excessive force case.
